1. Parties and purpose

These terms govern the purchase of licenses for the FanFan Control application through https://www.fanfancontrol.com, between Jaime Lillo Benito (hereinafter, "the owner"; full details in the legal notice) and the person making the purchase (hereinafter, "the user").

Making the payment constitutes full acceptance of these terms, the privacy policy, and the refund policy.

3. Purchase and delivery process

  1. The user clicks the purchase button and is taken to Stripe's secure checkout, where they enter their email address and payment details.
  2. Once payment is confirmed, a cryptographically signed license key is generated automatically and sent to the email address provided.
  3. The user enters the key in the application, under "Enter license."

Delivery is immediate, typically in under a minute. If the email doesn't arrive, check your spam folder and, if needed, write to soporte@fanfancontrol.com, and the license will be resent at no cost.

The owner grants the user a non-exclusive, non-transferable, indefinite-duration license to install and use FanFan Control, within the following scope:

Serious breach of these restrictions entitles the owner to terminate the license. Ownership of the software's intellectual property remains with the owner at all times: what is sold is a right of use, not the software itself.

5. Technical requirements

FanFan Control requires macOS 12 (Monterey) or later, on Intel or Apple Silicon Macs. Manual fan control requires installing, once and with the user's express authorization via their administrator password, an auxiliary system component.

Before purchasing, users have access to a free version with no time limit — including monitoring and manual fan speed control — to check compatibility and performance on their own machine. The Pro license unlocks the automation features.

6. Updates and support

Updates to the purchased version are included at no extra cost. The owner does not commit to any specific release schedule for new versions, nor to indefinitely maintaining compatibility with future versions of macOS.

7. Warranty and liability

The owner is liable for lack of conformity of the digital content under the terms set out in Royal Legislative Decree 1/2007 (the recast text of Spain's General Law for the Defense of Consumers and Users). If the application does not work as described, the user is entitled to have it brought into conformity or, where applicable, to a price reduction or termination of the contract.

FanFan Control includes safety safeguards, including a forced return to the system's automatic mode when CPU temperature exceeds 95 °C. Even so, the user bears responsibility arising from the deliberate use of manual settings unsuited to their machine.

Except in cases of willful misconduct, gross negligence, or harm to life or physical integrity, and without prejudice to the mandatory rights afforded to consumers, the owner's liability for damages arising from use of the software is limited to the amount actually paid for the license.

8. Withdrawal and refunds

These are governed by the refund and right-of-withdrawal policy, which forms an integral part of these terms.

9. Governing law and dispute resolution

These terms are governed by Spanish law. In the event of a dispute, the consumer may bring proceedings before the courts of their own domicile.

Users may direct any complaint to soporte@fanfancontrol.com, which will be handled within one month at most.
